    Your terrorist is better treated than mine, By Hassan Gimba

    Last week, a Federal High Court judge, James Omotosho, sentenced separatist leader Nnamdi Kanu to life in prison after convicting him on seven terrorism-related charges.

    This came after a decade-long trial in which prosecutors proved that his broadcasts and orders to his banned Indigenous People of Biafra (IPOB) group incited deadly attacks on security forces and citizens.

    Prosecutors had sought the death penalty, but the judge noted that “it is now being frowned upon by the international community. Consequently, in the interests of justice, and to temper justice with mercy, despite Kanu’s arrogance and lack of remorse, I hereby sentence the convict to life imprisonment … instead of the death sentence.”

    Omotosho also told the court that the “right to self-determination is a political right,” but added that “any self-determination not done according to the constitution of Nigeria is illegal.”

    However, the arrest, trial, and subsequent conviction of Kanu have revealed a nasty side of us as a people.

    Those sympathetic to him—mostly from his geopolitical zone—believe the government mistreated him, arguing that terrorists from other zones are negotiated with, granted amnesty, and rehabilitated. They accuse the government of double standards, especially when compared with its handling of notorious bandit leaders like Bello Turji, who operates in the North West. Even ace broadcaster Rufai Oseni confronted the government, questioning why terrorists who abducted schoolgirls in Kebbi were allowed to walk free while Nnamdi Kanu faces maximum punishment.

    On 11 July 2021, in a piece titled “Between Kanu, Igboho, Gumi and Southern Governors,” I wrote: “A Methodist Bishop ridiculously said he would stand by Kanu as long as ‘northerners stand by Pantami and Gumi.’ A well-known southern columnist also questioned how Kanu and Igboho were arrested, while Gumi got a slap on the wrist.

    “What they refuse to accept is the fact that Kanu is a terrorist in the class of Shekau. A fugitive from justice who jumped bail while standing trial in a court of competent jurisdiction. Whereas he picked up arms against his country, the others did not. He instigated people to kill through electronic messages; the others did not.

    “He calls for the balkanisation of the country. Perhaps being a second-class British citizen, he sees Nigeria as a ‘zoo’ and Nigerians as animals. His gullible followers, Nigerians through and through, accept being animals in a country that is a zoo. Maybe because most of his followers are those frustrated with their lives, they find solace in living in utopia. They claim they are Jews.

    “Laughable as it was, with no historical or biological evidence to support the phantasmagoric claim, they do not know, nor do they seek to understand, the history of the Ethiopian Jews. The Ethiopian Jews, immigrants and descendants of immigrants from Beta Israel, known as the Falashas (Falash Mura), trace their history back to 325 CE, when Ezana became emperor of Axum.

    “And even with this rich and ancient history, the ‘real’ Jews did a DNA test to confirm their Jewishness. They studied samples from Falasha Jews and Ethiopians with the Y-chromosome-specific DNA probe to screen for TaqI restriction polymorphisms and haplotypes.

    “Two haplotypes (V and XI) are the most widespread in Falashas and Ethiopians, representing about 70% of all haplotypes in Ethiopia. Because the Falasha population lacks Jewish haplotypes VII and VIII, they concluded that the Falasha people descended from ancient inhabitants of Ethiopia who converted to Judaism. Therefore, they do not have the same rights as the real Jews in Israel.

    “So, just because you wake up in a state of hallucination, start wearing the Jewish kippah or yarmulke (also called kappel or skullcap), drape over your shoulders their tallit and hold their tzitzit (rosary), and call yourself a Jew does not make you one—just as speaking through the nose and decking yourself in a three-piece suit does not make you a white man.

    “Claiming to be them and calling your country a zoo will not make Netanyahu come to your aid when caught by nemesis. He does not even know you exist. The world sees you for what you are: a madman. No wonder one of his incoherent phrases that his demented followers love parroting is ‘mad people everywhere,’ not knowing it is about them.”

    Both Kanu and Turji have committed heinous crimes against the people. Both have killed or caused the killing of innocent civilians, military personnel, and other members of our security agencies. This is true of Shekau as well, long before Turji appeared on the scene. I recall the comparison I made between Imam Shekau and Mazi Kanu in my write-up of 24 July 2022, “Open Letter to Ndigbo,” where I wrote: “Perhaps the only difference between the leader of the terrorist organisation in your area and that of Boko Haram is that Boko Haram’s Imam is in the trenches with his troops while your Mazi is with his family, ensconced in the White man’s land, feeding fat at your expense. No wonder someone referred to him as a ‘made-in-China Shekau’.”

    That notwithstanding, our penchant for rivalry and fighting one another like step-siblings has brought us to the sorry pass where we hate other terrorists but embrace those who share our language and ethnicity.

    So, for us to start “fighting” over how “our terrorist” is being “maltreated” and raising our blood pressure because “your terrorist” is being “pampered” is simply mind-boggling. Can people really go this low?

    For too long, we have allowed sentiment to cloud our utterances and actions. It is high time we treated criminals without undue regard to their race or religion. Partial tolerance of terrorism will destroy us.

    PRESIDENT TINUBU’S STATEMENT ON THE KILLING OF SOLDIERS IN ABA

    I have received yet another disheartening news of the killing of five soldiers by suspected militants of the proscribed terrorist organization, IPOB.

    The slain soldiers were on peacekeeping duty in Aba, Abia State on Thursday when they were murdered, just two months after a similar tragic incident happened in Okuama in Delta state.

    These unwarranted barbaric and evil acts stand condemned and should never be condoned and tolerated in our country.

    Our soldiers and the police have the onerous duty to protect all of us from aggressors and non state actors. Hundreds of them have paid the ultimate price in fulfillment of their duty, while some have experienced the indignity of being manhandled by the people they protect.

    They surely do not deserve the mindless attacks by unruly elements in our society.

    The federal government will come down heavily against those who have made it a habit to needlessly attack the officers and men of our armed forces.

    On no account should anyone, under any guise, have the audacity to kill agents of state.

    I want to make it clear that the government of the Federal Republic of Nigeria and the armed forces have the capacity to crush violent non-state actors, making our communities unsafe.

    I urge security agencies not only to fish out the masterminds and perpetrators of the Aba attack, but also those calling on people to stay at home. Their action is nothing but a treasonable offence.

    The fact that the security forces are exercising necessary restraints should not be mistaken for weakness.

    We are working to build a peaceful and harmonious society, but nobody should be under any illusion that the government will not act appropriately when the lives of our officers and men are wantonly taken.

    While my condolences go to the families of the five slain soldiers, their colleagues and the leadership of our armed forces, I urge other men and women on peacekeeping duty not to be discouraged by the unfortunate incident in Aba.

    Enough! Nnamdi Kanu Orders Ekpa to Stop Sit-At-Home in South East

    Reprieve may soon come the way of Nigerians in the South East as the detained leader of the Indigenous People of Biafra (IPOB), Maxi Nnamdi Kanu, has ordered his Finland-based self-acclaimed disciple, Simon Ekpa, to end all sit-at-home in the South East.

    That’s not all. The IPOB leader also directed Ekpa to stop antagonizing governors of the south east geo-political zone, and politicians from the region. He warned that anyone enforcing sit-at-home in the region was not his disciple and should be made to face the full wrath of the law.

    Kanu, who is still being detained by the Department of State Services, DSS, gave the directive in a letter he personally wrote to Ekpa, which was released to the public on Friday by his Special Counsel, Aloy Ejimakor.

    Ejimakor, who disclosed this to journalists in Enugu, Wednesday, said that “the Public Announcement bears the unedited, verbatim instructions containing a Direct Order personally issued by MAZI NNAMDI KANU in his own handwriting on 24th July 2023 through me to MAZI SIMON EKPA, instructing him to ‘desist from calling for any Sit-at-Home henceforth’ and ‘to make a public announcement to the effect that he (Mazi Simon Ekpa) is in receipt of a direct order from him (Mazi Nnamdi Kanu) to cancel any pending Sit-at-Home in place at the moment;

    “Simon, this is a direct order from me,” Kanu declared in the letter. “I hereby instruct you to desist from calling for any sit-at-home henceforth. Equally, refrain from antagonising governors or persons in political positions because you are not in a position to know what they are doing on my behalf.”

    Not only that, Kanu also ordered Ekpa to make a public announcement that he had received a direct order from him (Kanu) to cancel any pending sit-at-home in place at the moment.

    “I embarked on this movement to liberate our people, not to enslave them,” Kanu said in the letter.  “I despise and will despise any person or entity that wishes to inflict unnecessary hardship on our people. I have authorised Aloy to issue a press statement if you fail to make this announcement on your platform,”.

    Kanu put a final seal on the matter when he declared that “anybody still engaging in sit-at-home is not my disciple,” adding that “haters of Biafra and mindless murderers in uniform are hiding under the cover of combating enforcers of Sit-at-Home to unleash mayhem against the same people we swore to defend.

    “I have sent countless messages to those purportedly enforcing sit-at-home that they are not doing so in my name,” said Kanu who is currently in DSS custody.  “I am not begging anybody to release me, just that Nigeria should have the decency to obey their own laws.”

    Photo of Congolese model digitally altered to add Nigerian separatist leader

    A recent social media post published with a photo claims that the image shows Nigerian separatist leader Simon Ekpa on a beach with a woman, “enjoying life in Finland”. But the claim is false: AFP Fact Check established the picture was digitally altered, with Ekpa’s face superimposed on another man’s body.

    “This is Simon Ekperima the criminal, enjoying life in Finland while his fellowers (sic) are being killed everyday in Nigeria,” reads a tweet published on July 11, 2023.

    “Simon Ekperima” refers to Simon Ekpa, the factional leader of the Indigenous People of Biafra (IPOB).

    IPOB is pushing for the independence of Nigeria’s southeast region. Its followers have a history of sowing disinformation, with multiple claims debunked by AFP Fact Check.

    The post, retweeted more than 1,000 times, was shared by Nigerian musician Charles “Charly Boy” Oputa.

    Oputa has also been the subject of previous AFP Fact Check debunks, including here and here.

    IPOB

    Calls for a separate state of Biafra remain a hot-button topic in Nigeria more than half a century after secessionist leader Chukwuemeka Ojukwu declared the independence of the country’s southeast in 1967. This was followed by a brutal 30-month civil war.

    A faction of the group loyal to Finland-based Ekpa recently declared a two-week-long curfew in the region to protest the continued detention of IPOB leader Nnamdi Kanu. Kanu is facing trial for treason and terrorism.

    The violent crackdown on defaulters of the curfew has been widely criticised (archived here). Local media said gunmen enforcing the curfew killed at least three people. Other IPOB members distanced themselves from Ekpa’s order, calling it “irresponsible”.

    But the claim that the photo shows Ekpa with a woman on a beach is false.  

    Ivorian comedian

    AFP Fact Check conducted reverse image searches on the photo and found that an Instagram page called “observateur_ebene” published the original on March 31, 2021.

    The account belongs to an Ivorian comedian called Florent Amany, popularly known as Observateur Ebene (archived here). He shared the same image on Facebook (archived here).

    The caption on Instagram said the images showed the comedian and a Congolese model whose was mentioned in the post.

    The photo in the false tweet was altered, with Ekpa’s face replacing Amany’s.

    Matching elements in the two images include the logo on the man’s boardshorts, the drawstring, creases on the hat, the necklace and towel around the man’s neck, and the woman holding a mobile phone.

    IPOB Terrorist Leader, Simon Ekpa, Arrested in Finland By Police

    Popular Nigerian separatist agitator Simon Ekpa has been arrested by Finnish authorities.

    According to news from Finland,  the police escorted the separatist out of his apartment in Lahti on Thursday.

    Criminal Investigator, Tommi Reen from the Central Criminal Police told the HS news outlet that the Keskusrikospoliisi (KRP), the National Bureau of Investigation (NBI) in Finland had a police operation in a private apartment in the centre of Lahti.

    The platform claimed that they had gone to Ekpa’s residence for an interview but the Finland police, KRP, surprisingly answered when the HS team rang the separatist bell.

    The Nigerian government had asked Finland to intervene in the operation of a separatist in Lahti. On Thursday morning, KRP prevented HS from entering Ekpa’s apartment and said the interview would move to “the future”.

    We had agreed on an interview at Ekpa’s apartment near the Lahti market. Still at 10.06, Ekpa had released a tweet for nearly 70,000 followers.

    “We Biafra’s people are fighting until the end this time,” the last post read.

    Ekpa drives Biafra’s independence in Southeastern Nigeria without losing. He encourages people in social media to boycott the Saturday presidential election.

    On Thursday, ECPA does not say that he would not participate in the elimination of government people. He even leads and acquires weapons. ”

    ECPA claims that he has become a substitute for the Director of the Indigenous People of Biafra (IPOB) separatist movement, Nnamdi Kanu, after he was arrested. He also claims to determine the IPOB armed wing Eastern Security Network (ESN).

    But the skein is complicated. Part of those who claim to be IPOB or ESN members are blaming the first lying and abuse of the name of the cane.

    The intention is to demand the forefront to explain what his separatism and the opposition to the election are all about.

    We are late. Ekpa’s neighbor will soon open the door to the stairwell. The journey breaks down.

    The police are waiting for the police from the Central Criminal Police.

    “The interview goes to the future,” he says.

    When asked if the interrogation is long or the fact that the person we are looking for after them is not possible to meet, the police respond that “both and”.

    “Krp is doing his job here,” he says.

    The photographer who was on the site of HS later testified when civilian cops led Simon Ekpa out of the apartment.

    Criminal Inspector Tommi Ree of the Central Criminal Police confirms to HS on the phone that KRP had a police operation in a private residence in the center of Lahti on Thursday during the ongoing pre -trial investigation. Police caught one man from the apartment. KRP suspects the man arrested for the crime, but does not comment at this stage of the crime title.

    Reen did not confirm the man’s identity, but only talked about the operation in the apartment in the center of Lahti at a general level. He did not comment any further.

    Nigeria has asked Finland to intervene in Ekpa’s activities. Last week, the Nigerian Foreign Minister invited the Finnish Ambassador to Leena Pylvinäinen’s meeting due to the subject.

    Jussi Nummelin, Western and Central African team leader of the Finnish Ministry for Foreign Affairs, told HS a week ago that Finland is concerned about the safety of Finland, and condemns violence and incitement, and “actions aimed at preventing people from exercising their democratic rights.

    The Indigenous People of Biafra, IPOB, Wednesday, gave a stern warning to anyone or group of people planning any attack against Igbos or Igbo interest during the fast approaching general elections to think twice before embarking on any unholy mission or there would be consequences.

    In a statement, the separatist movement declared that any attack against Igbos during the forthcoming 2023 elections would be reciprocated.

    IPOB’s spokesman, Emma Powerful, who gave the warning  in a statement declared:

    “The attention of the global movement and family of the Indigenous People of Biafra (IPOB) under the command and leadership of our great leader Mazi Nnamdi KANU has been drawn to a threat from a small village Monarch in Yoruba Land to the effect that they will deal with non-indigenes, especially Ndigbo who doesn’t vote in the upcoming elections according to the wish of the monarch. This sort of threat tells you all you need to know about the Nigerian selection process, which they like to call an election.

    “IPOB as a freedom movement do reaffirm our non-recognition and or participation of (in) the Nigerian electoral process because the results do not represent the will of the people, and this is why an idiot somewhere will have the gumption to threaten what they called non-indigenes and the Igbo nation in particular. While we Biafrans await a date for Referendum, nobody should threaten Ndigbo and Biafrans residing temporarily in other parts of Nigeria for any reason.

    “IPOB want to state unequivocally that any attack in any part of Nigeria on the Biafran people or the Igbo Nation or their properties on account of the choice of individuals to participate and vote according to their conviction during this so-called election will be met with adequate and commensurate action.

    “We urge men and women of good conscience in the North and West to caution their traditional rulers and politicians who want to use Ndigbo and Biafrans as scapegoats in this skewed election process to be very careful and retrace their steps. Gone are the days when Ndigbo will be threatened and intimidated during elections. As long as Biafrans have not been given the opportunity to exit Nigeria via a referendum, IPOB will not stand by and watch anyone Nigerian or non-Nigerian to threaten Biafrans or carry out such threats against us and get away with it.

    “Even as IPOB do not wish to be drawn into the ZOO politics, nobody has the right to threaten Ndigbo or attempt to compel them to vote for a particular party or candidate. Any Biafran who wants to vote in this election has the right to vote for any party or candidate of his/her choice, and nobody should direct or threaten them to vote for a particular party in their community or state. If anyone threatens to attack Ndigbo and Biafrans or non-indigenes residents in your place, be rest assured that the people being attacked will not sit and watch their property and life being destroyed and will activate their right to Self Defence.

    “We are urging Ndigbo, Biafrans and non-indigenes everywhere to be prepared to defend their property, family and their own lives during and after this election period. Do not allow anyone to use you or your family as a sacrificial lamb this time around.

    “It is very imperative that we remind those who think highly of themselves and believe they will resort to violence and attack Biafrans that they do not have the monopoly of violence. Until Referendum is conducted and Biafrans exit Nigeria, those who have the habit of threatening and attacking Ndigbo must understand that it will not be business as usual this time around because their lives also will be in danger when they attack others.

    “These nitwits believe that Biafrans are soft targets to threaten and attack at will well they should know that it will not be so this time around. These morons never threatened fulani not vote for any other party except their own party and their own person but rather directed their misguided outbursts against Biafrans and Indigbo. We dare them to attack NDIGBO and Biafrans this time around and see what will happen.”

    The Nigerian Army has denied viral report that a female officer who was abducted on Boxing Day by men suspected to be militants of the proscribed Indigenous Peoples of Biafra, IPOB, and its paramilitary arm, the Eastern Security Networ, ESN, has been freed.

    In a statement on its verified Facebook Page, the Army dismissed the report that Lieutenant P. P. Johnson, a female officer who was abducted on December 26, 2022, while visiting her grandmother in Aku-Okigwe in Imo state, has been rescued.
    Lt. Johnson had travelled to Imo State shortly after completing her Cadet training and subsequent commissioning as a Lieutenant into the Nigerian Army.
    Her abduction, according to a viral video, was in furtherance of the separatist agitation against the Nigerian state for an independent state of Biafra.
    bUt in a press release, the Army said, Friday, that “the information making the rounds is unsubstantiated as the officer is yet to be released or rescued from her abductors. Likewise, the video footage being circulated and associated with the rescue claim is an old video of the arrest of a suspect earlier effected by troops.”

    ABDUCTED FEMALE OFFICER NOT YET RESCUED, SEARCH EFFORT STILL ONGOING
    The attention of the Nigerian Army (NA) has been drawn to some publications circulating in the social media insinuating the rescue of Lieutenant PP Johnson, a female officer who was abducted on Monday 26 December 2022 while visiting her grandmother in Aku-Okigwe in Imo state, shortly after completion of her Cadet training and subsequent commissioning as a Lieutenant into the Nigerian Army. A video footage of her abduction had emerged in the social media where her abductors claimed her abduction was in line with their fight for Biafra against the Nigerian State. It is instructive that the officer’s circumstance as a woman and a Nigerian citizen of South Eastern extraction did not dissuade her abductors from dehumanizing her in their mindless attempt to commit atrocities under the guise of fighting for Biafra. This evidently is another pointer to the myriads of crimes being unleashed by IPOB/ ESN on Ndigbo, the very people they claim to be fighting for their emancipation. It should therefore be crystal clear to those who are still in doubt of the true status of these groups, that IPOB/ESN are terrorists, masquerading as freedom fighters and do not deserve the support of anyone particularly the good people of South East Nigeria.
    The NA wishes to state that the information making the rounds is unsubstantiated as the officer is yet to be released or rescued from her abductors. Likewise, the video footage being circulated and associated with the rescue claim is an old video of the arrest of a suspect earlier effected by troops.
    Much as we appreciate the concern and goodwill of the general public for her safe rescue, we also wish to note that the information on the rescue of the officer did not emanate from the NA.
    The Nigerian Army will leave no stone unturned in its effort to rescue the officer and bring the perpetrators to book. We appeal to the general public to provide credible and reliable information that could lead to her safe rescue and arrest of the perpetrators.

    Police Nab 3 IPOB Members in Cross River

    The Police Command in Cross River says it has arrested three suspected members of the proscribed Indigenous People of Biafra, IPOB.

    The state Police Commissioner, Sule Balarabe, disclosed this during a parade of the suspects, who were arrested by the command between August and November.

    The commissioner gave the names of the suspected IPOB members as Richard Ukehad, 29; Esther Asado, 29 and Chief Isaac Ebebe, 44.

    He said that the suspects were arrested at their camp in Bebe III community in Obanliku local government area of the state following an intelligence report.

     “On the strength of the information, the military, in collaboration with Anti-Cultism/kidnapping squad, swung into action and the three were arrested,” he stated.

    The commissioner said that two dane guns, one Biafra uniform, one Biafra flag, one axe, knife, four explosive devices, two suspected explosive chemical, charms, a Police beret and live cartridge were recovered at their camp.

    Balarabe said that the suspects would be charged to court once investigation was completed on the matter.

    The commissioner further said that two persons were arrested for unlawful possession of firearm while one was also arrested for armed robbery and kidnapping within the same period.

    He disclosed that two AK47 riffles and 200 rounds of AK47 lives ammunition belonging to the kidnappers were recovered by the command.

    While promising to rid the state of crime and criminality during and after the yuletide, the commissioner warned politicians against violence and any unlawful act that would compromise peace in Cross River.

    According to him, “The command therefore warns all political parties, their candidates and supporters, to play by the rule and abide by all the laws guiding election process in the country as infractions would not be tolerated.”

    The Imo State Police Command has said its operatives killed a suspected member of the Indigenous People of Biafra IPOB and its affiliate Eastern Security Network (ESN) during a shootout while conducting stop and search duty along UBA Round About Orlu, Imo State.

    The Command also said that its operatives wounded several others who escaped into the adjoining bushes with fatal bullet injuries abandoning their sienna vehicle, one AK47 rifle with 15 rounds of live ammunition, two English made Pump Action guns with 10 rounds of live cartridges and assorted charms.

    The police spokesman, CSP Michael Abattam said the operatives were on duty when the hoodlums attacked and opened fire on the policemen.

    “When on 27/10/2022 at 0900hrs, luck ran against a six-man terror gang, suspected to be members of the Proscribed Indigenous People of Biafra (IPOB) and its armed affiliate, Eastern Security Network (ESN), who came in a sienna vehicle with registration number ABUJA-GWA 932 CQ, and attacked the Police operatives while conducting stop and search duty along UBA Round About Orlu, Imo State.”

    He said the hoodlums who came prepared, shot sporadically at the Police operatives, but were shocked by the alertness and dexterity displayed by the gallant police operatives who responded swiftly.

    In the gun duel that ensued, he said the hoodlums were overwhelmed by the superior fire power of the police and in the process “one of the hoodlums was neutralised while others escaped into the adjoining bushes with fatal bullet injuries abandoning their sienna vehicle.”

    According to him, all the abandoned items were recovered by the police operatives to the station, while the corpse was later deposited at a nearby mortuary.

    He said that preliminary investigation conducted, revealed that, the sienna vehicle used by the suspects was snatched from its owner in Amurie Omanze in Isu Local Government Area of Imo State.

    Nnamdi Kanu is Only Discharged not Acquited-Justice Minister, Malami

    The Office of the Attorney General of the Federation and Minister of Justice, Mallam Abubakar Malami, has reacted to Thursday’s court ruling on the rendition of Nnamdi Kanu, leader of the proscribed  Indigenous People of Biafra, IPOB, declaring that the judgement does not translate to a discharge and acquittal of the detainee.
    The Attorney General’s position was revealed in a press statement issued, Friday, in Abuja, by the Minister’s Special Assistant on Media and Public Relations, Dr. Umar Jibrilu Gwandu.
    This means it is not yet redemption song for Nnamdi Kanu who was arrested in Kenya in June, 2021, by Interpol, and was immediately handed over to Nigerian authorities and detained in the DSS facility.
    The Crest recalls that Kanu was first arrested in Lagos on October 14, 2015, and detained for more than a year, despite various court rulings ordering his release. The IPOB leader was finally released on bail on April 28, 2017. And he fled, first to Israel, then, the United Kingdom.
    Below is the full text of the statement by the Office of the Attorney General of the Federation and Minister or Justice on Thursday’s court ruling:
    The Office of the Attorney General of the Federation and Minister of Justice has received the news of the decision of the Court of Appeal concerning the trial of Nnamdi Kanu.
    For the avoidance of doubt and by the verdict of the Court, Kanu was only discharged and not acquitted.
    Consequently, the appropriate legal options before the authorities will be exploited and communicated accordingly to the public.
    The decision handed down by the court of appeal was on a single issues that borders on rendition.
    Let it be made clear to the general public that other issues that predates rendition on the basis of which Kanu jumped bail remain valid issues for judicial determination.
    The Federal Government will consider all available options open to us on the judgment on rendition while pursuing determination of pre-rendition issues.
